The scooter is brand new and I can't get it to idle or stay idles. I have to constantly give the throttle to keep it going and when it stops it dies. I also noticed that after filling the tank the gas quage des not move from empty? Any help would be appreciated.

As it's brand new and presumably has a warranty, take it back to where you bought it for them to sort out. The tickover should be no more than a turn of a screw but the fuel gauge issue might need a mechanic.good luck.
