Seeing as how you say the fault occurs after filling & this fault specifically refers to a filling problem and the machine has not attempted to drain any water out yet because it hasn't reached the drain step of the cycle, then no I don't think that the drian will affect this problem.

thanks. tried that but didnt change. but another thing i noticed is that our shower isnt draining properly as well. would the drainage effect the washing machine?

Fairly obvious. Two screws at top rear of panel. Remove screws & tilt panel forward.

ok thanks. but how do you get the contol panel off? sorry

Fault code 39 pressure sensor reading fault. Machine can detect that there is water in bowl but pressure sensor does not register a rise in level. Try this first. Make sure bowl is completely empty of water. Power off at wall. Open panel & locate air pressure tube on right hand side of control box. Pull tube off the connection to controller & blow down it to clear away any rubbish or water that may be causing a blockage. Put air hose back on the controller & close panel. Power on & try a wash. If fault still there then the pressure sensor in the controller may be faulty which will mean changing the whole controller.
